BariBuddy Terms of Use & Privacy Policy

These Terms of Use (“Terms”) govern your access to and use of the BariBuddy mobile application (“App”), which is provided by BariBuddy (“Company,” “we,” “us,” or “our”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please refrain from using the App.1. Acceptance of Terms
By using the App, you represent that you are of legal age to enter into these Terms, or if you are not, that you have obtained the necessary consent from a parent or legal guardian.2. Changes to Terms
We reserve the right to modify or update these Terms at any time. Significant changes will be communicated through email, push notifications, or in-app messages. Your continued use of the App after such changes are effective constitutes your acceptance of the revised Terms.3. License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial use only. All rights not expressly granted are reserved by the Company.4. User Accounts
Certain features of the App may require the creation of an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately if you suspect any unauthorized use of your account.5. User Data and Content
By using the App, you acknowledge and agree that information you provide—including user-generated content, preferences, and personal data—will be stored and processed by Firebase, a secure cloud service provided by Google. This data is used to enhance your experience and improve App functionality. You may request access to, correction of, or deletion of your data by contacting support@baribuddy.ca.6. Data Retention
We will retain your information for as long as your account is active or as necessary to provide you with services, comply with legal obligations, resolve disputes, and enforce our agreements. If you wish to close your account or request deletion of your data, please contact support@baribuddy.ca.7. Data Security
We take reasonable measures to protect your data; however, internet transmissions can be inherently insecure. By using the App, you acknowledge that we cannot guarantee absolute security, and you accept the risk of data transmission. We will not share your data with third parties without your explicit consent except as required by law.8. Third-Party Services
Our App integrates with third-party services, including Firebase by Google. By using the App, you agree to the privacy policies and terms of use of these third-party providers. We are not responsible for the practices or content of any third-party service.9. Limitation of Liability for Data Breaches
In the event of a data breach involving Firebase or any other third-party service, BariBuddy shall not be liable for any unauthorized access, disclosure, loss, or alteration of your data. You acknowledge that you use the App at your own risk.10. Prohibited Conduct and Content
You agree not to engage in any conduct that:
• Violates any applicable local, state, national, or international laws or regulations.
• Infringes upon or misappropriates the intellectual property rights of any third party.
• Uploads, transmits, or otherwise makes available any viruses, malware, spyware, malicious code, or any other harmful components that may damage or interfere with the operation of the App, other users' devices, or the infrastructure of the App.
• Engages in harassment, intimidation, abuse, or any behavior intended to harm, disrupt, or interfere with other users' ability to use the App or with the functioning of the App.
• Submits, posts, or transmits any illegal, defamatory, obscene, offensive, or otherwise inappropriate material, including but not limited to images, text, or other media.Any such illegal, harmful, or prohibited content will be immediately reported to the appropriate authorities. BariBuddy is not responsible for any such content, and reserves the right to take any necessary action, including the removal of such content and the suspension or termination of offending user accounts.11. Termination
We reserve the right to suspend or terminate your access to the App at any time and for any reason without notice. Upon termination, all rights granted to you under these Terms will immediately cease, and you must discontinue your use of the App.12. Indemnification
You agree to indemnify and hold harmless BariBuddy, including its affiliates, officers, directors, employees, and partners, from any claims, damages, losses, or expenses (including attorneys’ fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.13. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure.14. Limitation of Liability
To the fullest extent permitted by law, BariBuddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, lost profits, or business interruption, arising out of or related to your use of the App—even if we have been advised of the possibility of such damages.15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Alberta.If you have any questions or concerns about these Terms or our privacy practices, please contact us at support@baribuddy.ca.By using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
